In accordance with the laws in effect, the clients abroad may appoint the lawyers in China to be their agents in litigations. Following materials need notarizing when clients abroad appointing lawyers in China to be their agents:
(1) The client’s certificates of his or her identity such as ID Card, which needs notarizing in the country where he or she is staying at present
(2) The client’s marriage certificate, which needs notarizing in the country where he or she is staying at present as well.
(3) The letter of specific appointment with a unique format, which needs notarizing in the country where he or she is staying at present.
(4) If the party abroad is the plaintiff in the litigation, he or she has to give the notarized civil pleading to his or her agents in China. If the party abroad is the defendant in the litigation, he or she has to draw the declaration of divorce concerning his or her attitude on divorce, child custody and division of common properties. The declaration shall be submitted to the people’s court by the agent after notarizing in the country where he or she is staying at present. |
